Why Chief Justice of Nigeria Didn't Appear At Tribunal

Justice Walter Onnoghen, the Chief Justice of Nigeria (CJN), scheduled for arraignment for alleged false assets declaration charges, was not anywhere around the Code of Conduct Tribunal (CCT) yesterday.

His lawyers, led by Wole Olanipekun, a Senior Advocate of Nigeria (SAN), told the CCT that the CJN was not properly served the summons. He is to be personally served tomorrow.

CCT Chairman Danladi Umar called Justice Onnoghen’s case at about 10:08am. But the CJN did not attend yesterday’s proceedings at the Code of Conduct Tribunal (CCT), scheduled for his arraignment on charges of non-declaration of assets.

Olanipekun, SAN, led a retinue of lawyers, including 46 senior advocates, to defend the nation’s chief law officer.

At the commencement of proceedings and the mention of the charge, lead prosecution lawyer Aliyu Umar (SAN) informed the tribunal that the defendant had been served with the charge and that the day’s business was for the arraignment of the defendant.

Umar, however, noted that the defendant was absent and prayed the tribunal to inquire from the defendant’s lawyers why he did not attend proceedings.

He argued that having been served, the defendant had no reason to refuse to attend proceedings.

When Umar asked why his client was absent, Olanipekun said he (the CJN) was not properly served with the tribunal’s summons.

Olanipekun also said his client had filed an application at the Federal High Court, challenging the court’s jurisdiction. He asked that the application be taken without the CJN’s presence.

He cited many decisions of the Supreme Court and the Court of Appeal to support his argument that while a defendant is challenging a court’s jurisdiction or the competence of the charge against him, such a defendant need not attend court.

He said: “The position of the law is that where a defendant in criminal trial is challenging jurisdiction, he does not need to appear in court.”

Olanipekun also cited sections of the Administration of Criminal Justice Act (ACJA) to support his argument that his client was entitled to personal service of the court summons.

He faulted the information by the tribunal’s registrar that the CJN directed his (CJN’s) Personal Assistant (PA) to accept the court summons on his behalf.

Olanipekun said while the information by the court official confirmed that personal service was not effected on his client, the acceptance of the summons by an aide to the CJN did not qualify as personal service, which is required under Section 123(a) of the ACJA.

He argued that under Section 124 of the ACJA, there is need for the prosecution to obtain the leave of the tribunal where it could not effect personal service on the defendant.

Olanipekun said he was surprised that the prosecution was talking of arraignment when proper service had not been effected on his client and he (the defendant) is appearing in protest to challenge the tribunal’s jurisdiction.

On the Chairman’s question whether or not the defendant was not aware of the pendency of the charge, Olanipekun said awareness is not the issue, but that the proper procedure provided in the law must be complied with.

Responding, Umar argued that no law allows a defendant to stay at home and challenge the jurisdiction of the court.

He contended that Sections 123 and 124 of the ACJA provide for personal service on the defendant.

Umar added that since the defendant directed that his PA should accept the summons, it ought to be taken that he had waived personal service.

He later suggested that the tribunal direct that a fresh service of the summons be effected personally on the CJN, a suggestion accepted by all. Tribunal Chairman Umar ordered a fresh service on the CJN and adjourned till January 22 for the hearing of all pending applications.

The CJN was charged with six counts of false asset declaration by the Code of Conduct Bureau (CCB) on January 10.

The charges followed a petition brought against him by a group, the Anti-corruption Research and Data Based Initiative, headed by Denis Aghanya.

In a statement, the CCT said it received the request for the trial of Justice Onnoghen on Friday and had slated yesterday to commence with the matter.

But a Federal High Court sitting in Abuja yesterday stopped the planned arraignment of the CJN before the CCT.

Ruling on two ex parte applications, N.E Maha, a judge, ordered parties to maintain status quo till January 17.

He ruled that the defendants should be served with all the papers filed and that they should appear in court at the next hearing.

Buhari Drops IGP Idris? Approves AIG Lafia As New Police Boss

Assistant Inspector General of Police (AIG) Abubakar Adamu Mohammed Lafia has been named as the acting Inspector-General of Police (IG).

Lafia's appointment reportedly got the blessing of President Muhammadu Buhari, who met with IG Ibrahim Idris, who is expected to bow out of service today after attaining the retirement age of 60.

The "unexpected" appointment came last nght following
opposition from some quarters against possible tenure extension for IG Idris, who has also attained the statutory 35 years in service.

It was gathered that the acting IG was selected by the president among three names submitted to him after weeks of shopping for Idris’ replacement.

AIG Lafia, The Nation gathered, is a course mate of Force Secretary AIG Taiwo Lakanu and former Economic and Financial Crimes Commission (EFCC) boss Ibrahim Lamorde.

Until his appointment, the Lafia, Nasarawa State-born AIG Lafia was serving at the National Institute of Policy and Strategic Studies (NIPSS).

It was gathered that the officer, who, like Idris, spent many years working with the United Nations (UN) and the International Police (INTERPOL), will be officially announced today (Tuesday).

Confirming the development to The Nation, a source close to IG Idris said the decision was taken yesterday.

The source said: “It is true but the announcement has not been made yet. Oga (Idris) retires on Tuesday (today) having clocked 35 years in service. He has done well for the police and brought in many innovations.

“The new IG once served as Deputy Commissioner in Ekiti State Command, among other postings.”

New Minimum Wage: We Are Monitoring NASS, says NLC

The Nigeria Labour Congress has said it is awaiting the transmission of an executive bill on the new minimum wage from the Presidency to the National Assembly.

There has been fear of fresh crisis in the negotiation between the organised labour and the Federal Government on the new minimum wage.

The fear followed a disclosure by a source at the NASS that
lawmakers would go on another recess on or before the presentation of the bill on January 23, 2019.

The recess, it was gathered, would enable the lawmakers to prepare for elections in the February 2019 elections.

The General Secretary of the Nigeria Labour Congress, Peter Ozo-Eson, told The Punch in an exclusive interview in Abuja that the union was watching the situation with interest and monitoring the activities of the National Assembly and Federal Government on the new minimum wage.

He said, “All we are concerned with is the agreement we have with the FG (transmission of the bill on or before January 23, 2019.) The matter of election timetable is up to them (FG and NASS). All we are concerned with is the Memorandum of Understanding that we had with the FG which has dates that things should be done. However they get that done within the election timetable is their own business.

“We do not want to keep going back and forth on this matter. We are holding the FG responsible for honouring the MoU which says the executive bill will be at the NASS by January 23, 2019. Once that is done, we will know how to engage the NASS.”

Also speaking with The Punch on the matter, the NLC’s Head of Information and Public Affairs, Benson Upah, said the new twist about election timetable and NASS recess were unnecessary distractions.

Upah said, “We are monitoring the situation at the NASS and hoping for the best and NASS members’ support to pass the bill. NASS members have in the past made sacrifices to advance the course of labour and democracy in the country. Therefore, we rely on them and will continue to solicit their support and understanding to ensure that this bill does not suffer any setback on account of their absence or otherwise.”

Asked if the NLC was worried that the issue of election timetable was being introduced into the process despite the MoU between the organised labour and the FG, Upah said it was an issue that were not envisaged by parties involved in the discussion in the past two weeks.

“When this process was perfected, we at labour did not envisage that it would drag to this time of the year. But now that it has happened, our prayer remains the support of the NASS members,” he noted.

Nobody Can Turn Buhari Against Me – Amosun

Ogun State Governor Ibikunle Amosun has said that nobody can turn President Muhammadu Buhari against him, ahead of the 2019 general elections due to his support for a guber candidate outside the APC.

He said, “All that they are doing is to turn President Buhari against me. Nobody can turn him against me. It is impossible.”

Amosun said this at Kajola ward in Obafemi Owode local council in continuation of his campaign to win the Ogun Central Senatorial poll.

However, the governor urged the people of the state to vote for Buhari, saying the President had added value to the development of the country and the state.

Amosun said, “Look at our railway, airport, power and many others, so we should all vote for him.”

He lamented that some people were trying to disrupt the peace in the state, urging the people to resist any attempt by “foreigners” to enslave them with their votes.

He added, “Where were they before this time, it is now that the state is fast developing that they want to disrupt its peace. Resist them, don’t allow anybody to enslave you.”

I Don't Know What Came Over Me, I Regret - Man Who Shot His Wife & 2 Sons

The Edo State Police Command, on Monday, paraded Uwaila Idehen, the 35-year-old man who allegedly shot and killed his wife and two sons in Benin.

Uwaila, who confessed to killing the victims, said he did not know what came over him when he carried out the act.

The incident occurred on Sunday at Ovbioge village in the Ovia North-East Local Government Area of the state.

He stated that he bought the double-barrelled gun from a late police officer, got a licence for it and was using it for hunting.

Uwaila said, “I am a tipper driver. We are two in my family, my elder sister and me. I am 35 years old. My wife had three children for me, a girl and two boys. The girl is six years and the boys were three and two years old, respectively.

“I don’t know what came over me and I was not drunk. Due to the nature of my job, my wife always accused me of having affairs with other women, but it is not true.

“Anytime she saw me with my female customers, she would start an argument with me, but I always assured her that there was nothing like that and that my concern was how to take care of the three kids we had together.

“I always walked away whenever she provoked me; but on Sunday, I didn’t know what came over me. Instead of just leaving the house, I picked up my gun and shot through the door and the bullets pierced through the plywood door and hit my wife and the two boys. The girl narrowly escaped.”

The state Commissioner of Police, Hakeem Odumosu, said the suspect would be charged for outright murder and perhaps unlawful possession of firearm.

IGP Idris Clocks Retirement Age Today

The Inspector-General of Police, Ibrahim Idris, is expected to retire from the Nigeria Police Force today (Monday), having clocked the mandatory retirement age of 60.

But there had been speculations that his tenure might be extended by the presidency, which seemed to think that his removal might affect their expectations for the 2019 general elections.

But various groups, including the Coalition of United Political Parties, had opposed the planned tenure elongation.

Idris, who was the 18th indigenous IG, was born on January 15,1959 and enlisted into the force in 1984.

He was appointed IG on March 21, 2016, by President Muhammadu Buhari.

The President is expected to announce an acting IG pending confirmation by the Nigeria Police Council which is comprised of the President as the Chairman; state governors; the Chairman of the Police Service Commission and the IG.

Buhari left the nation guessing about his next move last week when he said he would make a decision on Idris’ tenure soon. Idris spent some part of Monday at the Presidential Villa, where he held a closed-door meeting with Buhari.

CJN Onnoghen's Case: APC, PDP In War Of Words

The imminent arraignment of Chief Justice of Nigeria (CJN) Walter Onnoghen before the Code of Conduct Tribunal (CCT) has pitted the All Progressives Congress (APC) against the Peoples Democratic Party (PDP).

The ruling party yesterday took exception to an allegation by the PDP that APC and its candidate in the February 16 presidential election, President Muhammadu Buhari, are behind the CJN’s ordeal.

PDP spokesman Kola Ologbodiyan accused the President and the APC of being desperate to remove Justice Onnoghen because of the forthcoming elections.

Ologbodiyan, who spoke for the PDP Presidential Campaign Organisation (PPCO), alleged that the ruling party was on a mission to annex the judiciary.

But the APC fired back through its Publicity Secretary Lanre Issa-Onilu, accusing the PDP of trying to hoodwink Nigerians into believing that the allegations against the CJN had political motives.

Issa-Onilu said the interest shown so far by the PDP in the CJN matter since it was brought to the limelight on January 7 had given the party out of having some unholy alliances with the judiciary.

He said the law should be allowed to run its course.

The APC spokesman urged Nigerians to caution the opposition party over what it called virulent attacks on the party and institutions of government.

Nigeria, Issa-Onilu said, is bigger than any political party or any political interest.

Speaking at a news conference in Abuja, Issa-Onilu also faulted the decision of the CJN not to appear before the CCT to answer charges bordering on false assets declaration preferred against him.

He alleged that such a decision could have been based on the suggestions of PDP governors from the Southsouth, who after their emergency meeting in Abuja on Sunday, urged the CJN to ignore the court summons.

The APC, he said, will not be drawn into debating the legality or sponsored conspiracies of the CCT trial because it believes it was an opportunity for the Chief Justice to exonerate himself and prove his innocence in the matter, adding that the issue concerning the CJN should be allowed to follow the due process of law.

He said the APC believed that democratic and constitutional institutions must be allowed to operate without interference and undue pressure from partisan and sundry interests as being done by the PDP and its cronies.

He said: “While we would not want to be lured into discussing issues that are presently before the courts and for which any respectable political party hoping to hold positions of responsibility should restrain itself, we regret to suggest that the PDP’s attempt to hoodwink Nigerians into believing that there is a political motive behind the allegation brought against the CJN might itself be indicative of some unholy alliances.

“The likely affinity existing between the PDP and a section of the judiciary is further accentuated by the nonappearance of Justice Onnoghen before the CCT on Monday (yesterday), in line with the suggestions made by the PDP governors from the Southsouth on Sunday.

“Are Nigerians expected to see this as a mere coincidence? Is the PDP and their governors acting a script? Haven’t we missed an opportunity to show confidence in an institution headed by the CJN?

“This becomes more worrisome knowing that the PDP’s campaigns have been receiving a cold shoulder everywhere they have gone to and it has become apparent the party and its presidential candidate are facing imminent defeat in the February 2019 elections and may be searching for some unorthodox means of forcing itself on the Nigerian people.

“If this were not so, the PDP should, before coming to these distracting conclusions, have taken cognisance of the facts of the allegations made against the CJN and his admission to the facts so stated.

“The only logical conclusion in the circumstance is that realising the refusal of Nigerians to allow the deception of the PDP con them into returning the party to power, the opposition party has alongside some pliable human rights activists devised a plot to distract the APC and indeed the good people of Nigeria from addressing the very important issues on the APC’s manifesto in the electioneering process.

“We have also noticed the very dangerous attempt to designate the CJN’s arraignment along ethnic and religious lines thereby trying to heat up the polity by evoking primordial sentiment which would do the country no good. This is an ungodly ploy when we consider that the CJN is an officer of the federation rather than that of any region.

“We therefore urge all Nigerians of good conscience to caution the PDP as the country is bigger than any political party or the interest it represents, and nothing should stop the country’s steady march into sustainable democratic governance.

“In our earlier statement on the CJN’s CCT trial, we had noted the PDP’s shocking and innate proclivity to defending cases of corruption anytime it arises. The call by the PDP’s Southsouth governors for the CJN’s boycott of the CCT trial further cements our position. Let it be reiterated that nobody, no matter how highly placed, should be above the laws of the land.

“We wish to put on record that the virulent attack that has come from the PDP in the wake of the trial of the CJN over alleged false asset declaration is particularly worrisome and suspicious when the PDP has, in fact, called for the removal of virtually all heads of government arms, particularly the Chairman of Independent National Electoral Commission (INEC) and Inspector-General of the Police over frivolous issues.

“While we will not be drawn into debates on the legality and sponsored conspiracies of the CCT trial, we insist that our democratic and constitutional institutions must be allowed to operate without interference and undue pressure from partisan and sundry interests as being done by the PDP and its cronies.

“The CCT trial is a legal matter; let the law run its course. The CJN must go through the instrumentalities of the courts, more importantly as an institution he represents. Indeed, this is the true test of our constitution, rule of law and will deepen democracy.

“Where there are contestations on institutional procedures, we must allow same institutions perform their functions unhindered, autocorrect if necessary and set good precedence on future matters. This is the only way we can build strong and lasting institutions.”

Also in a statement by Ologbondiyan, the PDP berated the President and the APC for, according to him, attempting to blackmail Nigerians who have raised a voice against the arraignment of the CJN before the CCT.

It accused the ruling party of attempting to subdue and annex the judiciary owing to agitation by Nigerians for the prosecution of the President’s cronies and some APC leaders for alleged corruption.

The statement reads: “The Buhari Presidency and APC in turning around to fight Nigerians have further exposed their desperation to replace Justice Onnoghen with a pliable CJN, who will execute their plots to use the courts to detain opposition leaders as well as vocal members of the Civil Society during the elections.

“It is now crystal clear to all Nigerians that apart from failing woefully in all its promises, the APC and its presidential candidate, President Buhari, are beginning to manifest their autocratic attributes..."

Foreigner Sits On The Floor At Lagos Airport Due To Lack Of Adequate Seats

At the General Aviation Terminal, Ikeja – more popularly known as Murtala Mohammed Local Airport 1, some foreigners were seen siting on the floor while waiting to board their flights yesterday.

These individuals decided to assume the sitting position due to the insufficient seating arrangement for travelers at the departure hall of the airport.

Ordinarily, due to the limited amount of seats at the departure hall, more travelers are left to stand. However, these foreigners decide to defy the norm by finding seating positions on the floor, probably because they were tired of standing.

Akpabio Being Protected By Presidency - Group Alleges

A group of concerned Nigerians under the umbrella of Civil Society Groups for Accountability and Probity have accused the Federal Government of shielding a former Governor of Akwa Ibom state and chieftain of the All Progressives Congress (APC), Senator Godswill Akpabio.

The group also urged the Economic and Financial Crimes Commission (EFCC) to synergize with the Code of Conduct Bureau and the Code of Conduct Tribunal to ensure Akpabio is brought to book.

Secretary-General of the group, Jonathan Ogwuche, who spoke on Monday in Abuja while making a submission to the EFCC, explained that the group is committed to the fight against corruption and strengthening of institutions, which the present administration and the EFCC have led with unprecedented milestones achieved already.

He, therefore, called on the Federal Government to commence actions and activities that would lead to the prosecution of Akpabio.

He noted that for such fight to be sustained, there should be no sacred cows, stressing that the Senator who has gotten his hands contaminated with proceeds of corruption and abuse of public also must also be made to face the consequence of their actions.

The group recalled that in October 2015, the commission quizzed Senator Godswill Akpabio over allegations of fraud to the tune of N108.1bn following a petition by one Leo Ekpenyong and is still awaiting the outcome of that investigation as unfortunately nothing has been heard to that effect while the suspect moves around freely.

“Consequently, sequel to our independent investigation, we want to bring the following crucial findings to the notice of your esteemed Office for further investigation and prosecution.

“In 2007 Senator Akpabio claimed to have eight ( buildings, while in 2011 he declared 10 (ten) buildings.

“Curiously however and of worrisome note, in 2016 following an investigative report by an online media, it was alleged that he was among those with properties in Dubai ( annexure 1)”, it stressed.

According to the group, contrary to claims by Sen. Akpabio, “the following outlandish properties located at the underlisted addresses could also be traced to him as follows: Plot 5 Ikogosi Spring Close, off Katsina-Ala Crescent, Maitama-Abuja; Plot 28 Colorado Close, Maitama; 22 Probyn Road, Ikoyi, Lagos and Plot 23 Olusegun Aina Street, Parkview, Lagos”.

The rest of their allegations made available to newsmen reads: “Clearly, these properties have been linked to the Senator. It has become pertinent that we bring to your notice the salient fact that these properties are conspicuously missing in the asset declaration forms of Senator Akpabio (see annexure 2)

“With the exception of a Bedford armour Bus which he claimed to be a gift, cars declared in 2007 were copied and pasted in 2011. This doesn’t represent the reality on the ground as he is known to move about in a fleet of cars.

“His child, Iniabasi who is said to have a property (duplex) in Abuja (in 2007 declaration) (at Games village) acquired on 1-1-2005 worth a value of N16.9m has an annual income of just N350,000, while in 2011declaration, the value remains unchanged.

“The source of the house is questionable. We can incontrovertibly submit that Senator Akpabio freely dished out the finances of Akwa Ibom State to his children, friends and other family members while corruptly enriching himself with same at the detriment of the State.

“We thus humbly request that the Chairman of EFCC use his esteemed office and investigative arsenal to review all prevailing and emerging findings on the Senator to unravel allegations of fraud against him.

“This investigation has become expedient in order to disabuse the minds of Nigerians with the notion and perception that the anti-corruption war has some sacred cows. If the Chief Justice of Nigeria can be dragged before the Code of Conduct Tribunal, we see no reason why Sen. Godswill Akpabio is being shielded from prosecution.

“Therefore, in the spirit of equality before the law, the EFCC is hereby called upon to synergize with the Code of Conduct Bureau and the Code of Conduct Tribunal to ensure Akpabio is brought to book”.

'Father Of DNA' James Watson Stripped Of Honors Over More Ugly Racism Comments

The acclaimed Nobel Prize-winning scientist James Watson will be forever remembered as one of the 'fathers of DNA'. But also as something much worse.

In a resurfaced controversy that further dims the shine of one of the 20th century's most esteemed scientists, Watson – awarded the Nobel in 1962 for his role in the discovery of DNA's 'double helix' molecular structure – has been stripped of academic titles after repeating offensive racist views that began to shred his reputation over a decade ago.

After new racist comments by Watson surfaced in the recent PBS documentary American Masters: Decoding Watson, Cold Spring Harbor Laboratory (CSHL) – the pioneering research lab Watson led for decades – had finally had enough.

"Cold Spring Harbor Laboratory unequivocally rejects the unsubstantiated and reckless personal opinions," CSHL said in statement.

"Dr. Watson's statements are reprehensible, unsupported by science, and in no way represent the views of CSHL… The Laboratory condemns the misuse of science to justify prejudice."

In the new documentary, Watson states: "There's a difference on the average between blacks and whites on IQ tests. I would say the difference is, it's genetic."

It's not the first time Watson has come under fire for stating these kinds of beliefs.

In 2007, Watson created a furore after he was quoted as saying he was "inherently gloomy about the prospect of Africa" because "all our social policies are based on the fact that their intelligence is the same as ours – whereas all the testing says not really".

“We went on extra mile to obtain an order given by Justice Alilu on January 9. He ordered that the defendant be remanded in police custody for an initial period of 14 days, “Mr Jolaawo added.

After listening to both counsels, the judge, Olasumbo Goodluck, adjourned to January 28 for continuation of hearing.
