Onnoghen's Suspension: US, UK Release Statements, Says They Are Deeply Concerned

The United Kingdom and US Embassy in Nigeria have both released statements concerning the sack of the Chief Justice of Nigeria saying the timing of the action, so close to national elections, gives cause for concern.

Below are their separate statements;

That of UK;

The British High Commission expresses serious concern over the suspension of the Chief Justice of Nigeria. We have heard a wide range of credible and independent voices, including in the Nigerian legal profession and civil society, who have expressed concern over the constitutionality of the executive branch’s suspension of the chief officer of the judiciary.

We respect Nigeria’s sovereign authority and its right to adjudicate on constitutional provisions but as friends of the Nigerian people, we are compelled to observe that the timing of this action, so close to national elections, gives cause for concern. It risks affecting both domestic and international perceptions on the credibility of the forthcoming elections. We, along with other members of the international community, are following developments closely.

We encourage all actors to maintain calm and address the concerns raised by this development through due process, demonstrating their commitment to respecting the constitution and the impartial administration of the rule of law. We further urge them to take steps to ensure that elections take place in an environment conducive to a free, fair and peaceful process.

US Embassy;

“The Embassy of the United States is deeply concerned by the impact of the executive branch’s decision to suspend and replace the Chief Justice and head of the judicial branch without the support of the legislative branch on the eve of national and state elections".

We note widespread Nigerian criticism that this decision is unconstitutional and that it undermines the independence of the judicial branch. That undercuts the stated determination of government, candidates, and political party leaders to ensure that the elections proceed in a way that is free, fair, transparent, and peaceful – leading to a credible result.

We urge that the issues raised by this decision be resolved swiftly and peacefully in accordance with due process, full respect for the rule of law, and the spirit of the Constitution of Nigeria. Such action is needed urgently now to ensure that this decision does not cast a pall over the electoral process.”

Coroner Reveals Kim Porter Died Of Pneumonia

Actress and model Kim Porter, found dead in November in her San Fernando Valley home, died from pneumonia, the Los Angeles County coroner's office announced Friday.

"The manner of death was certified as natural," according to a statement released by Sarah Ardalani, spokeswoman for the Department of Medical Examiner-Coroner. The autopsy report described "lobar pneumonia" as an infection of the lung caused by bacteria.

"Immune cells invade the air spaces (where oxygen is taken in) and this is accompanied with necrosis (death of cells). Pneumonia decreases the lungs' ability to take in oxygen and over time it can cause sudden death."

Porter was 47 when she was found unresponsive in her bed at home in Toluca Lake on Nov. 15, 2018, and was pronounced dead at the scene.

I Don't Wear Pants Anymore, Actress, Nazo Ekezie Says As She Reveals She's Single & Searching

Nollywood actress, Nazo Ekezie has disclosed she no longer wear pants due to the high demand of underwear by ritualists. She disclosed this to Sunnewsonline. She said;

She also spoke about being single, available and searching for a man.

“I’m single and available. I am looking for someone who fame doesn’t entice or affect. I want someone who would be patient enough to know me and not look at me from the movie angle. I would love someone who sees me as Nazo and not as an actress all the time.

“Right now, I seriously want to be in a relationship. I want to be with someone I love, someone who loves me as me, but not as an actress or movie star.

The Game Describes Vile S*x Act With Kim Kardashian In New Track

The Game has released a vile and degrading new track where he raps about choking Kim Kardashian during a sexual act.

On the offensive track, previewed during a listening party on Thursday night, The Game raps: 'I held Kim Kardashian by the throat, n***a.

'I made her swallow my kids until she choked, n***a. I should apologize cause 'Ye is my folks, n***a.'

Kim is thought to have briefly dated the rapper more than a decade ago, long before her marriage to now-husband Kanye West.

The reference to 'Ye in the lyrics is a clear acknowledgement that The Game is goading Kim's husband, his onetime friend, with the new track.

Previously, The Game has been much more reticent about his fling with Kim.

Back in 2016 The Game rapped about sleeping with three Kardashians in a track called Sauce. He then appeared on The Wendy Williams Show where he backtracked somewhat. Having denied dating Khloe, he was then asked about Kim.

'Kanye is great, Kim is great, they're great for each other, you know,' he said, avoiding answering the question.

He continued: 'Kanye is a really good friend of mine and you know, he's got a really good family structure,' he explained. 'I don't want to disrespect their family infrastructure.'

So what now got over him now?

Buhari & Desperate Action On CJN: Beginning Of Dictatorship?

Yesterday, President Muhammadu Buhari surrendered all pretence to the rule of law and constitutional democracy by sacking the Chief Justice of Nigeria, Walter Onnoghen. Unilaterally and in flagrant violation of the Constitution, he also swore in Tanko Muhammad as the new acting CJN.

By this act, the President has precipitated needless confusion in the polity. A shocking action, it will aggravate tension ahead of the general election in February and March. This poses a great peril to our democracy.

Though the President defended his action by citing an order from the Code of Conduct Tribunal directing Onnoghen’s suspension, his action is akin to a coup – a judicial coup in this case. In a subtle way, the President has suspended in part an integral part of the judiciary by illegally intimidating its highest symbol and shamefully deposing him. This undemocratic and high-handed approach advertises Buhari as an anarchist in a civil garb.

Onnoghen’s travails began late in 2016. His substantive elevation as the CJN suffered delay by the Buhari government to the bewilderment of the public. Early in 2017, he was eventually nominated by Vice-President Yemi Osinbajo, who was then the Acting President and was sworn into office in March (2017). But the real signs of trouble blew open on January 7 when a civil society group, the Anti-Corruption and Research Based Data Initiative, filed a petition with the Code of Conduct Bureau, accusing Onnoghen of corruption and false declaration of assets. The CCT immediately took over from there, commencing the trial of the CJN. Initially, the Buhari Presidency denied having anything to do with his arraignment.

In spite of criticism that the move against Onnoghen did not follow laid-down rules the trial proceeded with unusual speed. But on Thursday, the Court of Appeal, Abuja Division, in its ruling, ordered the CCT to stay action, pending the determination of Onnoghen’s application that the CCT had no power to try him. Before his suspension, Onnoghen was due to swear in members of the National Assembly, governorship and state assembly election petition tribunals.

No matter how grave the allegations levelled against the CJN, the Buhari government cannot resort to self-help in addressing the matter, much against the position of the 1999 Constitution. In the Third Schedule, Part 1, the constitution expressly states the procedure that should be followed in removing the CJN. The process is initiated by the National Judicial Council. According to Third Schedule, Part 1, Section 21 (b), “The NJC shall have power to recommend to the President the removal from office of the judicial officers specified in sub-paragraph (a) of this paragraph, and to exercise disciplinary control over such officers.” The officers listed therein are the CJN, Justices of the Supreme Court, the President and Justices of the Court of Appeal; the Chief Judge and Judges of the Federal High Court.

Buhari’s action is vile, perfidious and indefensible. It is an action only fit for jackboot regimes, where the constitution could easily be suspended, as the Murtala Muhammed military regime did in 1975 to remove the then CJN, Taslim Elias, from office. By igniting a bevy of crises in the judiciary just a few weeks to the general election, Buhari is apparently adopting Nicolas Maduro’s strategy in Venezuela. In the troubled country, Maduro seized the control of the apex court when he appointed a group of ruling party members to the bench in contravention of the constitution.

Needless to say, the President’s singular and misguided action has the tendency to plunge the country into an unnecessary constitutional crisis and, perhaps, derail 20 unbroken years of democratic governance. This is not unlike other despotic and undemocratic acts that the government has been associated with in the past, even if it might be considered more audacious, far-reaching and probably unexpected.

Buhari’s tenure has witnessed an invasion of a national newspaper, DAILY TRUST, over a publication considered to be offensive by the military. Despite numerous court orders, the Buhari government has refused to release the leader of the Islamic Movement in Nigeria, Ibrahim el-Zakzaky. The cleric and his wife, Zinat, were clamped into detention in December 2015 after Shi’ite members clashed with the convoy of the Chief of Army Staff, Tukur Buratai, in Zaria, Kaduna State. Likewise, the government has disobeyed several court rulings for the release – on bail – of Sambo Dasuki, the National Security Adviser under Goodluck Jonathan, Buhari’s predecessor. Dasuki is being tried for allegedly mismanaging $2.1 billion, fund meant to procure arms for the military to fight the Boko Haram insurgency.

On Buhari’s watch, Nigeria’s democracy looks treacherously shaky. In fact, Friday’s action, rightly termed a coup by another name, could only be matched by the invasion of the National Assembly last year by men of the State Security Service in a failed bid to force a leadership change. That was another act of meddlesomeness orchestrated against another arm of government that is the most emblematic of a democracy.

How do dictators hold onto power? James Tilley, a professor of politics at Oxford University, says the totalitarian tyrannies of Stalin, Hitler, Mao, Pol Pot, and others relied largely — although not exclusively — on mass terror and indoctrination. Nigerians must see through Buhari. He wants to convince the public that he is fighting corruption, but his hidden agenda is to institute an autocratic regime. Nigeria’s democracy can no longer be considered to be out of harm’s way. After close to three decades of brutal military dictatorship, the country deserves the right to enjoy her hard-earned democracy in peace. Nobody else can defend it but Nigerians themselves. It is, therefore time for the civil society to rise and nip in the bud what is turning out to be a gradual but seemingly inexorable descent into a full-blown dictatorship.

Just about two decades after Sani Abacha, Nigeria is, once again, in the grip of tyranny. The descent into the abyss of dictatorship must be stopped. This is the height of lies, denials and impunity that define Buhari’s three and half years rule. To restore sanity, rebuild trust in our fragile democracy, the President should swiftly reverse the dangerous violation of the 1999 Constitution, which he swore to uphold on assumption of office in 2015.

Update Robbery Suspects & Court Case: The Updates

Hearing in Offa robbery case began yesterday as a prosecution witness, Inspector Yusuf Dauda, opened his evidence and tendered as exhibits some ammunition, vehicles and car stickers allegedly used in the April 5, 2018 robbery operation in Offa, Kwara State.

Thirty three people including nine policemen were killed in the incident, which involved five commercial banks while an undisclosed sum of money was stolen from the banks.

Five people were standing trial in the robbery case and they were Ayoade Akinnibosun, Ibikunle Ogunleye, Adeola Abraham, Salaudeen Azeez and Niyi Ogundiran.

They were charged with armed robbery, illegal possession of fire arms and murder.

Testifying before the court presided by Justice Halimat Salman, Inspector Dauda who said he was an exhibit keeper at the Kwara State headquarters of the Nigeria Police, Ilorin claimed that on April 10, 2018, a former divisional police officer in Offa Local Government Area, CSP Danjuma Adamu, handed to him some weapons and ammunition allegedly used in the robbery operation.

Led in evidence by Prof. Wahab Egbewole (SAN), a private prosecutor, Dauda said the exhibits included 39 expended 7.6mm ammunition, two expended cartridges, four used bullets, one live 5.6mm ammunition, one cartridge safety box on which Ikoyi South-West, Lagos, Nigeria was written; and a damaged Padlock.

He also said that on April 15, 2018, Inspector Hassan, attached to the Inspector General of Police rescue team, also brought one Lexus Jeep on which a sticker bearing “Saraki “ was written with its key, a Compressor Mercedes Benz and four stickers bearing “Saraki.”

The prosecution tendered all the items as exhibits in the case.

Another witness, Inspector Hitila Hassan, attached to the intelligence unit of the IGP, said he was one of the officers that investigated the robbery operation and stated that he arrested the five accused persons standing trial in the case.

He said the robbery was conceived and planned by Ayoade Akinnibosun, Ibikunle Ogunleye and the late Michael Adikwu, who also supplied the ammunition and led the robbery operation on April 5 in Offa.

He said the meeting for the robbery operation was held in Ajase-Ipo and Oro town on April 2 and 3, 2018 respectively before it was executed on April 5, 2018.

Hitila said it was the CCT video clip footage that gave out the identity of the persons that participated in the robbery operation in Offa.

The police officer said that in the course of investigation, the police discovered that three vehicles: a Mercedes Benz Compressor belonging to Akinnibosun, a Volkswagen Audi 80 belonging to Adikwu and a Nissan Primera brought by other people that participated in the robbery but now at large were used for the operation.

He stated that in the course of investigation, Ibikunle Ogunleye confessed that he killed two of the robbery victims when they attempted to apprehend him while the operation was ongoing while Niyi Ogundiran and Adeola confessed that they killed two and five people respectively.

Hitila said two of the accused persons confessed that it was Adikwu who killed all the policemen because according to them, Adikwu shouted on top of his voice at the police station that “the Nigeria Police has offended him by dismissing him from service and he would take revenge.”

Justice Salman adjourned the case for further hearing till February 19 and 20, 2019.

Govt. Giving Out False Information To Raise Hope, says ASUU

The Academic Staff Union of Universities has accused the Federal Government of dishing out false information to raise the hope of Nigerians over the continued strike action embarked upon by the union.

The Chairman of Olabisi Onabanjo University, Ago-Iwoye branch of the union, Joel Okewale, stated this on Friday while briefing newsmen at the ASUU secretariat, OOU Mini Campus, Ago Iwoye.

The union blamed the strike on “Federal Government’s insincerity, deceitful approach and unwillingness to resolve the matter.”

Okewale stated this with the Secretary of the branch, Olugbenga Azeez, the immediate-past zonal coordinator (Lagos) of ASUU and a member of the union’s negotiating team, Adetola Nassir, and other branch executive members in attendance.

According to him, rather than addressing and resolving the main issues that led to the strike, the Federal Government is engaging in false information.

He said the FG had not shown serious commitment to defraying the outstanding N1.1tn revitalisation fund and the shortfall in salaries to the affected ASUU members, the situation which, according to him, would make the suspension of strike difficult.

“The revitalisation fund as contained in the 2013 Memorandum of Understanding and 2017 Memorandum of Action between the FG and ASUU are meant to ensure rapid transformation of Nigeria’s public universities for improved efficiency, infrastructural development and global competitiveness.

“The union has agreed with the FG to release the outstanding of the revitalisation fund in tranches at N220bn annually.”

Why I Was Honest With Osinbajo- Maintain

Weeks ago, popular singer, Olu Maintain, was pictured and even videoed discussing with Vice President Yemi Osinbajo; and this made some Nigerians curious. In a recent interview with the singer, he disclosed some of the things he was discussing with the VP.

He said he told the vice president the reasons why the current administration was unpopular among Nigerians. “When I met with the Vice President last year, I told him specifically that one of the reasons their government was unpopular was because they had put anti-corruption at the forefront of their agenda. I told him that you cannot position yourself as a single-policy government. President Buhari is not the minister for corruption, instead he is the President of the nation, so education, finance, power, among other things, must be put in place and people have to see a measurable reflection of growth in the country, which has not been the case.

“Their excuse might be that the situation has degenerated to a level whereby before they can enact any form of policy, they have to clean the house but nobody said that it was going to be easy for them to fulfil the promises that they made during their campaign. When I was talking to the Vice President, he was looking at me strangely and said that we should have more of this kind of discussion often. I was just telling him about the way I felt,” he said.

While putting his two cents in the current state of the Nigerian music industry, the singer who has been in the game for over a decade, gave reasons why he would never criticise the new generation of singers. He said not all singers could be like Fela. “We have to understand that music is art and the definition of art is very subjective. Fela positioned himself to be known as an artiste that sang purely about the social ills in the society. That is not just what music is about; it is just a part of music.

“I am one of the very few artistes that would not criticise anybody that decides not to do that because you have to understand that entertainment makes you conscious about what is going wrong in the society. Also, it creates a temporary relief for you to be able to deal with what is going on and still live a fulfilled life. Any artiste that decides not to be positioned as a socially conscious singer should not be criticised,” Olu Maintain said.
