Man Stabs Landlord To Death While Stopping Him From Beating His Own Mother

An landlord identified as Odiaka Moemeke, has reportedly been stabbed to death while attempting to separate a fight between a mother and his recalcitrant son.

Eyewitnesses said the son, one Gabriel Uwaya, who has been arrested by the police, allegedly stabbed the deceased in the throat as he attempted to stop him from beating his mother.

The incident happened on Tuesday on Anwai road, Asaba, Delta State capital. Sources said the 20-year-old suspect is a secondary school drop-out who took to beating his mother as a hobby.

Acting Public Relations Office of the state police command, ASP Chuks Orisewezie, who confirmed the incident and subsequent arrest of the suspect on Thursday, said it was not yet clear if the deceased was the landlord of the house where he was allegedly killed, The Sun reports.

Orisewezie said: “One Gabriel Uwaya was fighting the mother when one of his neighbours, Mr. Odiaka Moemeke, in the process of separating the fight, was stabbed to death by the young boy on Tuesday and (the latter) ran away.

“Our men have been searching for the suspect since the incident occurred but on Wednesday evening, we were able to arrest him.
“The deceased has been deposited in the mortuary. For now, I don’t know whether the said neighbour is his landlord or not. An investigation is still ongoing.”

A neighbour in the area who spoke on condition of anonymity described the death of Odiaka as painful.

“I know Odiaka very well; we were leaving together with his father before they built their house here on Anwai road. Odiaka was a young man of about 30 years old and just came back from Malaysia. So, it is very painful for such a young man who just came back to meet his death,” the neighbour said.

UNILAG Doctor Murdered 24 Hours After Graduating

A young UNILAG doctor Dr. Urueye Stephen aka Sarutobi, a House Officer at the Lagos University Teaching Hospital, has died 24 hours after graduating. Urueye was said to be walking along Idi-Araba road when he was accosted, robbed and stabbed.

Former UNILAG SUG president, Adeyeye Olorunfemi, who happens to be his friend has taking to Facebook to mourn him, writing;

FanYogo Gin, Ginger Not Registered – NAFDAC DG

The National Agency for Food and Drug Administration and Control (NAFDAC) says it has not registered FanYogo Gin and Ginger drink in Nigeria.

Its Director-General, Prof. Moji Adeyeye, made the clarification on Thursday in Abuja.

Adeyeye said that the drink, which contained 12.5 per cent alcohol and being circulated in the social media, was not a product of Fan Milk Plc.

Saraki, Dino Melya Asked To Surrender To Police

President Bukola Saraki, Senators Ben Bruce and Dino Melaye should submit themselves to the police for investigation for alleged breach of the public peace, a Federal High Court in Abuja has ruled.

Justice Okon Abang, in a judgment, declined a prayer by the three senators for an order nullifying the October 6 and 8, 2018 letters of invitation sent to them by the police.

The police invited them in relation to the protest on October 5 in Abuja by the PDP, shortly after the APC rigged the Osun State governorship re-run, which the Tribunal has declared as illegal.

Justice Abang said the police, by virtue of the provision of Section 4 of the Police Act, was empowered to invite anyone while carrying out its statutory functions of detecting and investigating crimes.

The judgment was in a fundamental rights enforcement suit filed on October 8, 2018 by the Senators, in which they claimed the invitation letters from the police breached their rights.

The judge said the invitations sent to them by the police did not amount to harassment and intimidation, as claimed by them.

Justice Abang was also of the view that the police, having alleged, in its response to the suit, that the PDP’s protest was dispersed following the protesters’ riotous and criminal conduct, it was within its (police’s) powers to invite suspects for questioning.

The judge added that the police invitation extended to the applicants remained valid, subsisting and must be honoured “without fail”.

Justice Abang said the senators could however complain of rights violation depending on the outcome of their honouring of the police invitation.

Rivers Supplementary Elections: INEC Fixes New Date

The Independent National Electoral Commission has fixed supplementary elections in some constituencies in River State for Saturday April 13, 2019. This is just as the commission set up a committee to look into the conduct of the lmo North Senatorial District election held on February 23 and March 9.

The resolutions were contained in a statement issued on
Thursday by INEC National Commissioner and chairman of its Information and Voter Education Committee, Festus Okoye. He said, “The commission met on Thursday April 4, 2019 and reviewed the conduct of the just-concluded Rivers State collation exercise. The commission expressed satisfaction with the outcome and commended the security agencies for their professionalism which ensured the peaceful conduct of the exercise.

“It also commended the political parties, domestic and international observers, other stakeholders and the people of Rivers State for their support and understanding which paved the way for the speedy and orderly conclusion of the exercise.

“However, supplementary elections will be held in some areas on Saturday, April 13, 2019, in line with the timetable released by the commission. The constituencies are Gokana, Opobo/Nkoro, Ahoada West and Abua/Odual.”

"The commission also deliberated on the conduct of lmo North Senatorial District election held on February 23 and March 9, and took into consideration a number of issues arising from the election.

“A committee has been set up to ascertain the veracity or otherwise of allegations of misconduct in the election. It is also to advise the commission on whether its procedures were complied with by officials. The committee is to submit its report on Wednesday April 10 2019.”

Guys Nabbed In Lagos For R*ping Family Friend's Daughter

An Ikeja Magistrates’ Court, Lagos, has ordered that two men, who allegedly r*ped a 13-year-old daughter of their family friend, be remanded in prison pending legal advice from the DPP.

They s*xually assaulted the girl on different occasions whenever her parents were not around.

Magistrate B.O. Osunsanmi ordered that Rasheed Kasali and Isiaka Adisa be remanded at Kirikiri Prisons. Osunsanmi ordered that the case file be sent to the DPP office.

The defendants’ pleas were not taken.

Kasali, 39, who lives at 18B, Dipo Olubi Street, Surulere, Lagos, and Adisa, 38, who resides at 11, Tosun Street, Itire-Ikate, Surulere, are facing a charge of r*pe.

Prosecuting Inspector Raphael Donny said the defendants committed the offence with two others at large last year at 6, Adebayo Street, off Ijesha Road, Surulere, Lagos.

Donny said the girl’s mother reported the case at the police station and the defendants were arrested.

INEC Replaces APC Candidate 3 Weeks After Election

The Independent National Electoral Commission has stopped recognising Lawrence Ezeh as the senatorial candidate of the All Progressives Congress for Enugu East, citing a court order.

On a list tagged, “Final list of senatorial candidates”, for the 2019 general elections published on its website, the electoral body replaced Ezeh’s name with that of Adaku Ogbu-Aguocha.

The change came about three weeks after INEC had concluded the National Assembly elections in which Ezeh was retained as the APC candidate, contrary to the February 19, 2019 judgment of the Federal High Court sitting in Enugu that nullified his candidature.

The court had declared that Ezeh was not properly nominated by APC, being a member of the opposition the Party during the primary election of the APC.

The court had further ruled that the plaintiff, Ogbu-Aguocha, who came second in the APC senatorial primary election held on October 2, 2018, was the rightful candidate since Uchenna Ezemba, who won the primary, had voluntarily stepped down.

Ezemba had, shortly after the primary election, announced her withdrawal to pave the way for Ezeh, who lost his bid to clinch the PDP ticket.

Ezeh, after his defeat in the PDP senatorial primary, defected to the APC where he was given the party’s ticket.

Consequently, Ogbu-Aguocha instituted a suit to challenge the decision of the party to field Ezeh whom she said never contested in the APC primary and was not a member of the party as of the time the primary election was held.

She, among others, prayed the court to declare her the duly elected candidate of the APC since Ezemba, who emerged winner of the primary, had withdrawn from the contest.

The presiding judge, Justice Ibrahim Buba, in the judgement, dismissed the objection raised by the defendant’s counsel that the case was statute-barred, explaining that the matter arose from an act of impunity, bordering on wrongful nomination and not substitution.

Declaring that the application by the plaintiff had merit and therefore succeeded, Justice Buba asked APC to forward the name of the applicant to INEC as the recognised candidate.
But INEC had yet to comply with the court order as of the time of the senatorial election.

Currently, Ezeh had filed a petition before the National Assembly Election Petitions Tribunal sitting in Enugu which he is seeking to nullify the election of Senator Chimaroke Nnamani of the PDP.

Court Orders Woman Who Killed Husband In Abuja To Enter Her Defence

A High Court of the Federal Capital Territory (FCT) in Maitama has ordered a woman, Maryam Sanda, to enter defence in her ongoing trial on murder charge, in which she is, among others, accused of killing her husband, Bilyaminu Bello.

Justice Yusuf Halilu, in a ruling yesterday, rejected Mrs. Sanda’s no-case submission and rejected her prayer to be discharged and acquitted.

Justice Halilu upheld the no-case submission by Mrs. Sanda’s three co-defendants and discharged and acquitted them on the grounds that the prosecution failed to establish a prima facie case against them.

Mrs. Sanda allegedly stabbed her husband, who was said to be a nephew of a former Chairman of the Peoples Democratic Party (PDP), Haliru Bello, to death in Abuja on November 19, 2017.

She was arraigned with her mother, Maimuna Aliyu; her brother, Aliyu Sanda; and their house help, Sadiya Aminu.

The prosecution had charged Mrs. Sanda with culpable homicide, and offence punishable by death, under Section 221 of the Penal Code Act.

The other three – Mrs. Aliyu, Sanda and Miss Aminu- were charged with causing the “evidence of the offence to disappear” by “cleaning the blood from the scene of crime with the intention” of shielding her “from legal punishment.”

The offence is said to be punishable under Section 167 of the Penal Code Act.

At the closure of the prosecution’s case, the defendants made no-case submissions on which the court ruled yesterday.

The prosecution closed its case on January 22, after calling six witnesses.

Justice Halilu, in his ruling, said: “The no-case submission of the 2nd, 3rd and 4th defendants is hereby upheld and they are hereby discharged and acquitted.

“The submission of no-case to answer by Maryam Sanda, the first defendant, is overruled. I call on the first defendant to enter her defence.”

According to Justice Halilu, the preponderance of evidence adduced by the prosecution, through its six witnesses, created “a thick cloud”, warranting the 1st defendant to present her own side of the case. The judge adjourned till May 6 for Sanda to present her case.

Buhari Gets NJC Recommendation To Appoint Tanko As CJN

With the recommendation of the National Judicial Council, the coast seems clear for Acting Chief Justice of Nigeria (CJN) Ibrahim Tanko Muhammad to mount the saddle as CJN. President Muhammadu Buhari is likely to accept the NJC’s recommendation that Justice Muhammad should be CJN.

But Buhari is said to be weighing whether or not to accept the NJC’s recommendations on the suspended Chief Justice of Nigeria ( CJN), Justice Walter Onnoghen.

Buhari, according to The Nation, who had a meeting with Vice President Yemi Osinbajo on the issue before flying out to Jordan yesterday, is also said to be seeking legal opinions on the NJC’s decisions.

The NJC absolved Justice Muhammad of any blame in deferring to the President to be sworn in as the Acting CJN.

He accepted the appointment, having been presented with an ex parte order of the CCT, which led to Justice Onnoghen’s suspension.

The Nation learnt that after receiving the NJC’s recommendations, the President elected to seek legal advice on them.

A top government official, who pleaded not to be named because he was not permitted to talk on the matter, said the President was considering:
  • whether or not NJC’s conclusions on findings on Onnoghen did not amount to indictment;
  • if he should accept NJC’s soft-landing decision to retire Justice Onnoghen with full benefits;
  • Onnoghen’s retirement without benefits; and
  • whether the law should run its full course, including the conclusion of Onnoghen’s trial by the Code of Conduct Tribunal and a fresh trial by the Economic and Financial Crimes Commission (EFCC).

Buhari is also believed to be thinking of asking NJC to recommend deterrence for Onnoghen or seeking further consultations with the council.

The President is also said to be planning to seek advice on whether the input of the Senate necessary in retiring Onnoghen?

The source said: “Since he received the NJC’s recommendations, the President has been thinking of how to manage the situation without rubbishing the anti-corruption agenda of his administration. He has the right to accept or reject the council’s recommendations on Onnoghen.

“The President is already seeking legal opinion on legal issues surrounding the NJC’s decisions. He does not want to set a bad precedent in tackling this Onnoghengate”.

The source confirmed that the President met with Vice President Yemi Osinbajo. He believed Onnoghen’s case and other matters were discussed.

Responding to a question, the source said: “What NJC decided was a kind of soft-landing for Onnoghen with moral and legal implications.

“Apart from stepping down, there are concerns about what Onnoghen is really offering as deterrent. Some are saying why can’t the law run its full course?

“Others are pressurising the government to take advantage of the window created by the NJC to rebuild the ties between the Executive and the Judiciary as a result of Onnoghen’s travails.”

It was unclear whether or not the President would need the consent of the Senate to retire Onnoghen.

“This is part of the legal opinion being sought by the President,” a presidency source said, pleading not to be named.

Section 231 of the 1999 Constitution says: “(1)The appointment of a person to the office of Chef Justice of Nigeria shall be made by the President on the recommendation of the National Judicial Council subject to confirmation of such appointment by the Senate.

“(2) The appointment of a person to the office of a Justice of the Supreme Court shall be made by the President on the recommendation of the National Judicial Council subject to confirmation of such appointment by the Senate.

“(3) A person shall not be qualified to hold the office of Chief Justice of Nigeria or of a Justice of the Supreme Court, unless he is qualified to practise as a legal practitioner in Nigeria and has been so qualified for a period of not less than fifteen years.

“(4) If the office of Chief Justice of Nigeria is vacant or if the person holding the office is for any reason unable to perform the functions of the office,’ then until a person has been appointed to and has assumed the functions of that office, or until the person holding the office has resumed those functions, the President shall point the most senior Justice of the Supreme Court to perform those functions.

“(5) Except on the recommendation of the National Judicial Council, appointment, pursuant to the provisions of subsection (4) of section shall cease to have effect after the expiration of three months from the date of such appointment, and the President shall not reappoint a person whose appointment has lapsed.”

Part 1 of the Third Schedule to 1999 Constitution says: “The National Judicial Council shall have power to:
  • (b) recommend to the President the removal from office of the judicial officers specified in sub-paragraph (a) of this paragraph, and to exercise disciplinary control over such office’s;
  • (c) recommend to the Governors from among the list of persons submitted to it by the State Judicial Service  Commissions persons for appointments to the offices of the Chief Judges of the States and Judges of the High courts of the states, the Grand Kadis and Kadis of the sharia Courts of Appeal of the States and Presidents and Judges of the Customary Courts of Appeal of the States;
  • (d) recommend to the governors the removal from office of the judicial officers specified in sub-paragraph (c) of this paragraph, and to exercise disciplinary control over such officers;
  • (e) collect, control and disburse all moneys, capital and recurrent, for the judiciary;
  • (f) advise the President and governors or any matter pertaining to the judiciary as may be referred to the Council by the President or the covernors;
  • (g) appoint, dismiss and exercise disciplinary control over member and staff of the Council;
  • (h) control and disburse all monies, capital and recurrent. for the services of the Council; and
  • (i) deal with all other matters relating to broad issues of policy and administration.

Meanwhile, the NJC has recommended the confirmation of Justice Ibrahim Tanko Muhammad as the substantive Chief Justice of Nigeria.

Another source said: “The council actually did not find him culpable of infractions. He actually did not even want to be inaugurated as the Acting CJN until there was evidence of an ex-parte order from the CCT on Justice Onnoghen’s suspension.

“As the next in-command, the NJC said he should take over from the CJN.”

When contacted, a source in NJC said: “In line with Section 26 of the Judicial Discipline Regulations of 2017, the council has reached out to all those affected by its decisions.

Section 26 says: “The decision taken in regulation 25 of these Regulations shall be notified to the following persons: (a)The subject of the decision; (b)The Complainant and (c) The relevant Head of Court

“Upon a request made to the Council, the decision may be notified to any other person. The grant or refusal of such request is in the absolute discretion of the Council.”

Group S*x With Drug: Third Student Confirmed Dead

The police in Imo State have confirmed the death of the third student among the four who allegedly engaged in a group s*x romp in a hostel close to FUTO on Tuesday.

The police who said that the three persons, including their female colleague were all students of the Federal University of Technology, Owerri, disclosed that substances suspected to be Tramadol and Indian hemp were found in the hostel where two out of the four students died on Tuesday.

The state Commissioner of Police, Rabiu Ladodo, who confirmed the death of the third student, Aka Uche, 27, to The Punch on Thursday, urged parents to discourage their children from taking to drugs.

The CP said, “Yes, I can confirm to you that the third student is dead. I just got the information today (Thursday) that he has died. He died in the hospital where he was admitted. His death has risen to three the number of persons who died from the incident. The girl among them is alive and I learnt that her condition is stable.”

Police Public Relations Officer in the state, Orlando Ikeokwu, had said, “On April 2, information was received from the caretaker of the Sunshine Lodge in Ihiagwa, Owerri, that the students of the Federal University of Technology, Owerri, Ugochukwu Kingsley, one Richard and one Aka Uche were engaged in a sex romp with one Onyinyechi Okafor, also a student of the same university.

“Police detectives from the Nekede Division promptly mobilised to the scene and found the four victims completely naked and unconscious. The police operatives recovered substances suspected to be Indian hemp and tramadol from the scene.

“The victims were immediately conveyed to the police clinic and two of the victims, Kingsley and Richard, were certified dead by the medical doctor on duty.”
