She became the talk of the night after standing behind stars on the red carpet with her tray of Fiji Water.
By the end of the night, there had been over 50,000 tweets mentioning her presence on the red carpet and the phenomena was born.
Fast forward to the Screen Actors Guild (SAG) Awards last weekend and she was once again seen on the red carpet - after a fashion.
This time it wasn't Kelleth Cuthbert in person but a cardboard cutout version of her and the model that caused a sensation was not happy her image had been used.
Kelleth, whose real name is Kelly Steinbach, is now suing Fiji Water and its parent company, The Wonderful Company, for allegedly creating a marketing campaign around her viral moment without permission.
Despite last minute negotiations with the 31-year-old model's agent, Fiji Water reportedly went ahead with the cutouts.
In documents filed to the courts, Kelleth alleged Fiji Water have capitalised off her image and likeness and had offered, "gifts to entice," her to give permission.
She is now demanding a payout but Fiji Water has refuted Kelleth's claims and stated the lawsuit is "frivolous and entirely without merit."
In a statement to People, the company said that they had, "negotiated a generous agreement with Cuthbert she blatantly violated.”
Kelleth has claimed she hadn't set out to become the star of the show and put it down to happening to look at the camera at the right time.
She said that with so many photographers and the number of stars on the red carpet, it was always going to be a possibility that she would be in the background of pics.
Now she wants Fiji Water to pay what she feels is a fair amount for using her image again as the awards season gathers pace.
